1. Exclusions of Liability
Any exclusions or limitations of liability in these terms do not apply to any damages arising from death or personal injury caused by the negligence of Bush Optics or its owners, employees, or agents, or in cases of fraud.
These exclusions shall be governed by and construed in accordance with the laws of Western Australia. If any provision within these exclusions is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and will not affect the validity or enforceability of the remaining terms.
Bush Optics does not guarantee, represent, or warrant that your use of our website or services will be uninterrupted, timely, secure, or error-free.
We do not warrant that any results or performance outcomes from the use of our products or website will be accurate or reliable.
You acknowledge that we may, from time to time, suspend or discontinue the website or our services without notice. You expressly agree that your use of, or inability to use, the website, our products, or our services is at your sole risk.
All Bush Optics products and services are provided “as is” and “as available” without any representations, warranties, or conditions of any kind, either express or implied, including implied warranties of merchantable quality, fitness for a particular purpose, durability, or non-infringement.
To the maximum extent permitted by law, Bush Optics, its owners, affiliates, agents, contractors, suppliers, or service providers shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind - including but not limited to loss of profits, revenue, savings, data, or replacement costs - arising from your use of our products or website, or any errors or omissions in any content, even if advised of the possibility of such damages.
Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such jurisdictions our liability shall be limited to the fullest extent permitted by law.
2. Product Use & Installation
All Bush Optics products are designed for use while parked or camping in 4WDs and touring vehicles. While every effort is made to ensure quality and durability, it is the user’s responsibility to install and use products safely and correctly. Bush Optics accepts no liability for any damage, injury, or loss resulting from misuse, improper installation, modification, or abnormal use of our products.
Professional installation is recommended for certain accessories or vehicle-mounted items.
Some Bush Optics products use adhesive-mounted components. As vehicle glass, tint film quality, age, and installation methods can vary, compatibility with all aftermarket tint films cannot be guaranteed. Customers are responsible for following all installation and removal instructions provided. Bush Optics accepts no liability for damage to aftermarket tint, glass, trims, or surfaces resulting from incorrect installation, removal, or use.
3. Vehicle Compatibility
Bush Optics provides shades designed for specific vehicle models. Customers are responsible for confirming that the product matches their vehicle make and model before purchase. While every effort is made to ensure accurate fitment, Bush Optics does not guarantee compatibility with all vehicles.
4. Outdoor & Environmental Wear
Bush Optics products are designed for outdoor conditions. However, exposure to extreme weather, UV light, salt, or harsh chemicals may cause natural wear or fading over time.
This is considered normal and not covered under warranty.
5. User Safety Responsibility
Users are responsible for ensuring that any Bush Optics product used on or around their vehicle does not interfere with vehicle operation, visibility, or safety systems. Bush Optics assumes no responsibility for accidents, injuries, or damage resulting from unsafe product setup or modification.
6. Taxes and Duties
Customers are responsible for any import duties, taxes, or other charges that may apply to international purchases.
7. Errors and Omissions
At Bush Optics, we make every effort to ensure product descriptions, pricing, and imagery are accurate and up to date. However, errors may occur, and information may change without notice.
In the event of a pricing or product error, Bush Optics reserves the right to cancel or refuse any order placed in error. If payment has been processed, a refund will be issued promptly.
Bush Optics also reserves the right to refuse any order, sale, or service at our discretion.
8. Returns and Refunds
Please refer to our Returns & Refunds Policy for full details on eligibility, processes, and timeframes. Bush Optics reserves the right to assess returned products for signs of use, modification, or damage prior to issuing refunds or replacements.
9. Intellectual Property
All content, logos, images, designs, and text displayed on this website are the property of Bush Optics unless otherwise stated. Reproduction, distribution, or use without written permission is strictly prohibited.
10. Customer Content and Social Media
Bush Optics may share customer-submitted photos, reviews, or social media content that features our products. By tagging or submitting content to Bush Optics, you grant us permission to repost or share such content for organic marketing and promotional purposes with credit to the original creator.
11. Jurisdiction
All sales are deemed to take place in the state of Western Australia, regardless of the customer’s location. Any dispute arising with Bush Optics shall be brought exclusively in the state or federal courts of Western Australia.
